Baltasar Garzón recently expressed his point of view before the decision taken by Cape Verde, in the case of his represented, Alex Saab; who has labeled the fact as a “juridical barbarism”.
“The decision of the judges of the TC, with all due respect, is more political than legal, and it is a legal barbarism, it cannot be said that the rights are for Cape Verdeans and not for others”, Baltasar Garzón, during a conference, in digital format promoted by the defense of the Venezuelan ambassador detained in Cape Verde.
Baltasar Garzón, former Spanish jurist and member of Alex Saab’s defense team; considered that the sentence of the Constitutional Court (TC) of Cape Verde became a more political than legal decision, refers a press release.
He further indicated;
“This whole issue is a clear operation backed by those who demand his extradition”, added the lawyer, blaming the influence of the United States for the arrest of Alex Saab.
Earlier, the defense demolished the decision of the Cape Verde Constitutional Court regarding the authorization of extradition to the United States and expressed dissatisfaction over the whole process of Saab’s detention.
“The Cape Verde Constitution has been shredded, the decision is a constitutional suicide that would make a law student blush, it is deplorable,” said one of the lawyers who intervened in the session.
Defense of Alex Saab
The defense of Alex Nain Saab, manifested all the actions that have been carried out in the case; being one of them the sending of letters to the judges of the Cape Verde Court. This in order for them to reconsider their decision in light of the inconsistencies and contradictions in the sentence.
Likewise, a letter will be sent to the president of Cape Verde highlighting that “the court said it could not decide on immunity because this is a political decision that has to be made by the government”, said the lawyer, who also stated that “one of the judges of the TC questioned the decision, but perhaps he was forced to agree with his colleagues.”
It is important to note that the Cape Verdean Constitutional Court, at the end of August rejected the appeal of Alex Saab’s defense against the decision to authorize the extradition to the United States. According to the ruling accessed by Lusa news agency.
“Dismiss the appeal filed by Mr. Alex Saab,” we read in the sentence 39/2021, dated August 30 and published on Tuesday, with 194 pages.
“Alex Saab, 49, of Colombian nationality and according to the defense with oncological health problems, was arrested by Interpol and Cape Verdean authorities on June 12, 2020, during a technical stopover at Amilcar Cabral International Airport, island of Sal, on the basis of an international arrest warrant issued by the United States, on a trip to Iran on behalf of Venezuela, as a “special envoy” and with a diplomatic passport.”
Alex Saab’s detention being the breaking point between the disputes between the governments of Venezuela and the United States. In relation to the diplomatic functions that the Venezuelan Ambassador exercised at the time of his detention; as well as the irregularities in the international arrest warrant and the illegal detention process.
