The team of lawyers of the Venezuelan ambassador Alex Saab, affirms that the case is not closed; they consider that the mechanism should not continue without the existence of an evaluation of the presuppositions of the process, which were not analyzed by the Court.
After the sentence of the Constitutional Court of Cape Verde to authorize the extradition of Alex Saab to the United States, they strongly rejected these illegal actions, since the appeal they filed to prevent this from happening was rejected.
Germano Almeida, one of the defenders of the Venezuelan special envoy, affirmed this Wednesday that his team expected that the judicial instance would attend their appeals and unconstitutionality arguments on the case. For this reason, he does not believe that the mechanism should continue without the existence of an assessment of the presuppositions of the process, which were not analyzed by the Court, so, like his fellow lawyers, he considers that the case of Alex Nain Saab cannot be closed.
“For us, the matter is not closed, because the agreement of the Constitutional Court says that this matter; not the one of double criminality, was not considered by any of the courts. This means that the case must return to the Court of Appeals to verify; the assumption that it did not analyze”, he referred, according to a note from the Portuguese service of the Voice of America.
In his opinion, Alex Saab’s case took a political nuance where the US power was involved.
“It does not make sense that the court is before a process and verifies that there are violations to the Constitution and ignores or dismisses it because, in fact, the process is not adequate, it does not make sense. The Constitutional Court did not do justice”, expressed Almeida.
Let’s recall that the Constitutional Court of Cape Verde authorized on Tuesday, September 7, the extradition to the U.S. of Saab, who has been detained in that African country since June 12, 2020, after declaring “inadmissible” the appeal filed by Saab’s defense.
